Payment Instructions:

1. All purchases will be paid in full in U.S. funds upon receiving invoice. Please bid only with available funds as Showtime Auctioneers will not finance any purchases.

2. Upon receiving full payment of invoice all lots will be released. Showtime Auctioneers will not release any assets based on partial or incomplete payments. All assets on invoice will be ‘held’ until invoice is paid in full.

3. Wiring Instructions will be sent with all invoices.

4. In the event payment is not received within 48hours we may report to the various bidding platforms we use and add buyer to "Black List".

Shipping Instructions: Showtime Auctioneers will not provide shipping or loading services. All buyers will need to schedule their own transportation and loading needs.

Loadout Yard #1: 3,000# Skid Steer available to loadout at no cost. 30,000# Forklift Available at $75/hr. with 1 hour minimum. Showtime reserves the right to refuse to loadout anyone and this is an extra service and not included in any purchase price what so ever. Any payment for loadout will be billed separately.

Terms And Conditions

1. Introduction
This Auction Buyer's Agreement (the "Agreement") governs the terms under which buyers may participate in auctions conducted by Showtime Auctioneers, LLC ("Auctioneer" or "Showtime Auctioneers"). By bidding at any auction conducted by Showtime Auctioneers, you, the "Buyer," agree to abide by the terms and conditions set forth herein, along with any additional notices or announcements made during the sale.

2. Definitions

• "Auction" means any auction conducted by Showtime Auctioneers, LLC.

• "Auctioneer" refers to Showtime Auctioneers, LLC, its representatives, agents, and authorized persons conducting the auction.

• "Lot" refers to an individual item or group of items offered for sale at auction.

• "Hammer Price" means the highest bid accepted by the Auctioneer for a Lot.

• "Commission" refers to the fee payable to the Auctioneer, calculated as a percentage of the Hammer Price.

• "Buyer" refers to the individual or entity placing the highest bid for a Lot at auction.

• "Reserve Price" means a confidential minimum price established by the seller for a Lot.

• "Purchaser" refers to the successful bidder who purchases a Lot from the Auction.

• "Sale Proceeds" refers to the amount payable to the Seller after commission and expenses have been deducted. 

3. Auction Participation

• To bid at a Showtime Auctioneers event, you must first register as a bidder.

• By registering and bidding, you agree to adhere to these Terms and Conditions.

• All bids are legally binding. If you are the highest bidder at the conclusion of the auction, you are the Purchaser of the Lot.

4. Bidder Responsibilities

• Buyers must conduct their own due diligence regarding the description, condition, and legality of any Lots.

• The Auctioneer makes no warranties regarding the accuracy of descriptions, illustrations, or information related to the Lots.

• All Lots are sold "as is" without warranties.

• The Auctioneer reserves the right to refuse any bid, split or combine Lots, or withdraw Lots from the sale at its discretion.

5. Auctioneer's Role

• Showtime Auctioneers acts as an agent for the Vendor (the seller), and the Auctioneer is not a party to the contract of sale between the Vendor and the Buyer.

• The Auctioneer reserves the right to regulate the bidding, resolve disputes, and re-offer Lots as deemed necessary.

• The Auctioneer is not liable for any failure of internet or electronic bidding services or any other issues that may arise during the auction.

6. Payment and Fees

• The Buyer agrees to pay the full Hammer Price plus applicable commission and any other fees.

• A Buyer’s Premium (typically a percentage of the Hammer Price) will be added to the final price of the Lot.

• Payment must be made immediately after the auction ends unless otherwise agreed.

• Accepted payment methods include wire transfer, credit card, or check (subject to approval).

• Showtime Auctioneers reserves the right to charge late fees and interest if payment is not received by the due date.

7. Title and Risk

• Title to the Lot passes to the Buyer only upon full payment of the Hammer Price and any other applicable charges.

• All Lots remain the responsibility of the Vendor until payment is received. Once full payment is made, the Buyer assumes full risk and responsibility for the Lot.

8. Taxes

• The Buyer is responsible for any sales tax, VAT, or other taxes applicable to the purchase of the Lot.

• If applicable, sales tax will be added to the Hammer Price at the prevailing rate in the jurisdiction of the auction.

9. Reserves and Withdrawals

• All Lots are sold with reserve unless otherwise stated.

• Showtime Auctioneers reserves the right to withdraw any Lot from the auction at any time before or during the auction without liability.

10. Compliance with Laws

• The Buyer agrees to comply with all applicable local, state, and federal laws and regulations related to the purchase of any Lot.

• Buyers purchasing items subject to export controls or other legal restrictions are solely responsible for ensuring compliance with these laws.

11. Disputes and Liability

• In the event of a dispute regarding a Lot, the Auctioneer’s decision will be final.

• The Buyer agrees to indemnify and hold harmless Showtime Auctioneers, LLC, its employees, and agents from any claims arising out of their participation in the auction or the purchase of a Lot.

• Showtime Auctioneers is not liable for any damages, including consequential or incidental damages, arising from the sale or non-sale of any Lot.

12. Default and Breach

• If the Buyer defaults on payment or fails to complete the transaction, Showtime Auctioneers reserves the right to: 

• Retain the deposit or full payment.

• Cancel the sale.

• Resell the Lot and charge the Buyer for any costs incurred in the resale process.

13. Pickup, Storage, and Resale

• All Lots must be picked up within 14 business days of the auction date unless otherwise stated.

• If a Lot is not picked up within 14 business days, Showtime Auctioneers reserves the right to charge a storage fee of $35.00 per day for each additional day the Lot remains uncollected.

• After 30 calendar days, if the Lot has not been picked up, Showtime Auctioneers reserves the right to resell the Lot at a future auction. A 10% commission will be charged on the sale of the resold Lot, and any storage fees accumulated will be deducted from the sale proceeds.

• The Buyer agrees that Showtime Auctioneers is not responsible for any loss, damage, or deterioration of the Lot after the 14-day period.

14. Privacy and Data Protection

• The Auctioneer will collect personal information from bidders for the purpose of conducting the auction.

• By registering to bid, the Buyer agrees to receive marketing and auction-related communications from Showtime Auctioneers unless they opt out.

15. Governing Law and Dispute Resolution

• This Agreement is governed by the laws of the state of Texas.

• Any disputes arising from this Agreement or participation in an auction shall be resolved through binding arbitration in Tarrant County, Texas.

16. Miscellaneous

• This Agreement constitutes the entire understanding between the parties.

• No modification of these Terms and Conditions shall be valid unless in writing and signed by both parties.

• If any provision of this Agreement is found to be unenforceable, the remainder shall remain in effect.

By registering and bidding in any auction held by Showtime Auctioneers, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
